IMPORTANT NOTICE TO CLIENTS (Effective August 7, 2025)
TERMS AND CONDITIONS
THIS DOCUMENT IS A LEGALLY BINDING CONTRACT ISSUED BY DRAKE HOSPITALITY GROUP, LLC D/B/A LAVISH LIFESTYLES CONCIERGE (HEREINAFTER KNOWN AS “SERVICE PROVIDER”) AND ACCEPTED BY CLIENTS SUBJECT TO THE IMPORTANT TERMS AND CONDITIONS (“TERMS”) BELOW. WHEN THE CLIENT COMPLETES THEIR BOOKING AND SUBMITS PAYMENT, THE CLIENT ACCEPTS THESE TERMS AND ANY OTHER TERMS AND CONDITIONS THAT THE CLIENT IS PROVIDED DURING THE BOOKING PROCESS.
IT IS IMPORTANT THAT THE CLIENT CAREFULLY READ ALL OF THE TERMS PRIOR TO BOOKING.
1. Booking & Payments
A non-refundable deposit of $499 per person is required to secure your spot.
A second payment of $2,250 is due October 1, 2025.
A final payment of $2,250 is due November 1, 2025.
Clients may instead pay in full ($4,999) at time of booking.
All payments are non-refundable and non-transferable. Failure to make timely payments may result in cancellation of the Client’s reservation without refund.
Credit Card Authorization: By booking, the Client authorizes the Service Provider to charge the Client’s credit card for the deposit or full payment at the time of booking, as well as for any scheduled installment payments. The Client affirms they are the authorized cardholder and agrees not to initiate a chargeback for payments made in accordance with these Terms.
2. Cancellations & Changes
All payments are strictly non-refundable and non-transferable. This reflects the non-refundable terms of our hotel partners and private service providers, especially during the peak holiday season (Christmas and New Year’s). Many of the curated experiences included are secured with non-refundable commitments to ensure exclusivity and availability.
If the Client cancels for any reason, no refunds or credits will be issued.
This trip requires a minimum of 6 travelers to operate and has a maximum capacity of 20 travelers. If the minimum group size is not met, the Service Provider reserves the right to cancel the trip. In such case, Clients will receive a full refund of payments made, which constitutes full settlement.
The Service Provider is not responsible for missed flights, changes in flight schedules, unused services, or early departures.
For your protection, comprehensive travel insurance is strongly recommended and may be required to cover unexpected cancellations on the Client’s part (illness, family emergency, work conflict, etc), as well as medical emergencies or trip interruptions.
3. Included & Not Included
Included: Accommodations, meals, activities, curated cultural experiences, and transportation as outlined in the published itinerary, along with services of the trip hosts.
Not Included: International airfare, passports, visas, vaccinations, travel insurance, personal expenses, hotel incidentals, room upgrades, late check-outs, early check-ins, and meals or activities not listed as included.
4. Prices & Arrangements
Prices are quoted in USD. Any currency conversion fees are the client’s responsibility
Lavish Lifestyles Concierge is under no obligation to provide a breakdown of costs of any trip.
Pre and post-tour extensions are only available to Clients booked on related group trips.
Modification of group trip content to accommodate a smaller group size will not affect the published group trip price.
The Service Provider reserves the right to modify the program or itinerary due to supplier availability, safety, weather, or other unforeseen circumstances, while maintaining the quality of the experience.
The prices are inclusive of all local taxes and gratuities in Ghana, if applicable, any required state or federal taxes will be remitted from the total trip price and will not be charged additionally to the traveler.
(B) CURATED EXPERIENCES
Sightseeing & Itinerary: Land travel will be via SUV’S . Some days may have a very early morning start time for sightseeing in order to complete the excursion during daylight hours. CLIENT’S are responsible for arriving on time for all scheduled group experiences and airport transfers. There is a 10 minute grace period to be at designated pickup point for excursions originating at the host hotel. After the grace period if CLIENT is still not present, CLIENT will be considered a "no-show," and will need to get transportation to destination at their expense. CLIENT acknowledges not being on time hinders the group schedule, in which case the CLIENT will not be eligible for a refund for the unused service(s) or reimbursement of taxi/uber or other mode of transportation.
5. Client Responsibilities
Client must have a valid passport with at least 6 months’ validity beyond the return date.
Client is responsible for obtaining any required visas, vaccinations, or entry documents.
Client is responsible for ensuring they are medically and physically fit to travel.
Client must disclose at time of booking any condition that may require reasonable accommodation, special request, or need of any kind by calling 310-499-3968 or notifying the Service Provider in writing. Failure to do so may result in inability to accommodate the request.
Client acknowledges that the Americans with Disabilities Act (ADA) does not apply outside the United States. Accessibility standards abroad may differ and may present challenges.
6. Health & Safety
Client acknowledges that travel carries inherent risks, including illness, injury, accidents, or unforeseen events.
The Service Provider is not responsible for illness, injury, medical costs, or disruptions arising during the trip.
Clients are required to secure comprehensive travel insurance covering trip cancellation, medical emergencies, and baggage.
7. Conduct & Group Experiences
Clients are expected to be respectful , punctual, and considerate of fellow travelers, hosts, and staff.
Disruptive, unsafe, or disrespectful behavior that negatively impacts the group experience may result in removal from the trip, without refund
8. Force Majeure
The Service Provider is not liable for delays, changes, or cancellations caused by circumstances beyond its control, including but not limited to natural disasters, pandemics, weather, strikes, government actions, civil unrest, public health emergencies, or supplier issues.
9. Limitation of Liability
The Service Provider acts solely as an organizer of travel services. Hotels, restaurants, airlines, transportation providers, and other suppliers are independent contractors and not employees or agents of the Service Provider.
The Service Provider is not liable for acts, errors, omissions, delays, or negligence of suppliers.
The Service Provider is not responsible for loss, injury, property damage, delays, or expenses incurred due to third-party actions or events outside its control.
10. Indemnification & Hold Harmless
By booking, the Client agrees to release, indemnify, defend, and hold harmless Drake Hospitality Group, LLC d/b/a Lavish Lifestyles Concierge, its owners, officers, employees, contractors, representatives, and agents (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, causes of action, damages, losses, costs, or expenses (including attorneys’ fees) arising from or related to the Client’s participation in the trip, including but not limited to:
injury, illness, death, or property damage;
delays, cancellations, or disruptions caused by airlines, hotels, transportation providers, government actions, or other third parties;
any acts, omissions, or negligence of third-party suppliers or independent contractors;
the Client’s own acts, omissions, or violations of these Terms.
The Client acknowledges that travel involves inherent risks and voluntarily assumes full responsibility for any and all risks, known or unknown, associated with participation in the trip.
11. Photography & Media
By participating in the trip, the Client grants the Service Provider the right to use photographs and video taken during the trip for promotional purposes (including print, digital, and social media) without compensation. Opt-Out: If the Client does not wish to be included in media, they must notify the Service Provider in writing at least 30 days before departure.
12. Governing Law
These Terms are governed by the laws of the State of New Jersey, USA. Any disputes shall be resolved exclusively under that jurisdiction through binding arbitration.
